This Indenture made the ffifth Day of December in the seventh Year of the Reign of our Sovereign Lord George the Third by the Grace of God of Great Britain ffrance and Ireland King Defender of the ffaith and so forth and in the Year of our Lord One thousand seven Hundred and Sixty six Between James ffarrer of Barnbrough Grange in the County of York Esquire of the one Part and John Winterbottom of Strinds in Sadleworth in the County aforesaid Clothier of the other Part Witnesseth that in Consideration of the yearly Rent herein after reserved to be paid and of the Covenants and Agreements herein after contained on the Part of the said John Winterbottom his Executors and Administrators to be performed He the said James ffarrer Hath demised leased set and to ffarm letten and by these Presents Doth demise lease set and to farm lett unto the said John Winterbottom All that Messuage or Tenement standing and being at Strinds in Sadleworth aforesaid now in the Demize Holding or Occupation of the said John Winterbottom his Assigns or Undertenants And all those several Closes ffields and Parcels of Land to the said Messuage or Tenement belonging or therewith now occupied lying and being in Sadleworth aforesaid and called or known by the several Names of the Highmost ffield, the Croft, the Middle ffield, the But, the Meadow, the Lowmost ffield, and the Great ffield containing ffourteen Acres or thereabouts of Statute Measure and now also in the Demize Holding or Occupation of the said John Winterbottom his Assigns or Undertenants Together with all and singular Houses Outhouses Buildings Barns Stables Orchards Gardens ffolds Yards Banksides Ways Paths Passages Waters Watercourses Liberties Easments Priveledges Hereditaments and Appurtenancies thereunto belonging or appertaining And also Common of Pasture and Turbary upon the Moors Commons and Wasts of Sadleworth aforesaid so long as the same shall lye open and uninclosed but not in any Part or Parts of such Commons or Wasts as shall hereafter be inclosed from or after such Inclosure be made and so as much Common of Turbary hereby granted shall extend only to the said demised Messuage and Turbary to be used and expended therein and not also where Saving and excepted unto the said James ffarrer his Heirs and Assigns all Timber and other Trees growing or being or to grow or be in or upon the said Premises or any Part thereof and all Mines Doins and Quarries of Lead Iron Stone Coal Cannel Stone and Slate and all other Minerals and ffossils of what nature or kind so ever and also all Marle in the said Premises with full Liberty to and for the said James ffarrer his Heirs and Assigns and his and their Agents Servants and Workmen at all Times during the Term of One Hundred and ffifty Years herein after mentioned to rid up pill back fell work break up put down and carry away the said Trees entire or in pieces or the same or any Part or Parts thereof to burn and convert into Charcoal upon the said Premises and for that purpose thereon to dig take and use Earth or Soyl and also to dig delve sink sough for and get the said Lead Iron Stone Coal Cannel Stone and Slate and other the said excepted Minerals and ffossils and the said Marle and the same to fetch bear load and carry away at his and their Wills and Pleasure And also saved and reserved to the said James ffarrer his Heirs and Assigns full and free Liberty at all Times hereafter during the said Term of One Hundred and ffifty Years to Hawk Hunt ffish ffowl and Course in over and through the same hereby demised Premises or any Part thereof and the Game there found and taken to bear and carry away at his and their Wills and Pleasure To Have And To Hold all and singular the said Premises herein before mentioned to be hereby demised with the Appurtenances unto the said John Winterbottom his Executors Administrators and Assigns in manner following, that is to say, the Lands and Grounds of the said Premises from the ffeast of the Purification of the blessed Virgin next and the said Messuage Buildings Barns Stables ffolds Yards and Banksides from the first Day of May next for and during the full end and Term of One Hundred and ffifty Years from thence next ensuing and fully to be compleat and ended Yielding and paying therefore yearly and every Year during the said Term hereby granted unto the said James ffarrer his Heirs and Assigns the Rent or Sum of nine Pounds and nine Shillings of lawful Money of Great Britain at the ffeasts of Pentecost and Saint Martin the Bishop in Winter by even and equal portions clear of all Lays Taxes Impositions and Deductions whatsoever the first payment thereof to begin and be made at the ffeast of Pentecost next Provided always and these Presents are upon Condition that in Case the said yearly Rent or any Part thereof shall be in arrear or unpaid by the spare of twenty Days next after other of the said Days whereon the same is herein before omitted to be paid That then it shall be lawful to and for the said James ffarrer his Heirs and Assigns into and upon all and every the said demised Premises or any Part thereof in the Name of the whole to enter and the same to have again to possess and enjoy as of his and their former Estate any thing herein before contained to the contrary in any wise notwithstanding And the said John Winterbottom for himself his Executors Administrators and Assigns doth covenant promise and agree to and with the said James ffarrer his Heirs and Assigns in manner following, that is to say, that he the said John Winterbottom his Executors Administrators or Assigns shall and will well and truly pay or cause to be paid to the said James ffarrer his Heirs and Assigns the said yearly Rent of nine pounds and nine shillings at such Days and Times and in such Manner and fform as the same is herein before reserved to be paid And that the said John Winterbottom his Executors Administrators and Assigns shall and will yearly and every Year during the said Term yield and deliver to the said James ffarrer his Heirs and Assigns at Christmas a fat Capon or one Shilling in Money at the Election and Choice of the said James ffarrer his Heirs and Assigns and also shall and will at all Times during the said Term do and perform to and for the said James ffarrer his Heirs and Assigns all such other like Boons Suits Duties and Customs as other Tenants of the said James ffarrer in Sadleworth aforesaid have usually done for the like quantity of Land herein before demised and yearly Rent herein before reserved And also that he the said John Winterbottom his Executors Administrators and Assigns shall and will grind all the Corn Grain and Malt which during the hereby granted Term shall be spent ground upon the said demised Premises or which during the said Term shall be the Growth or Product of the said Premises and shall be sold or otherwise disposed of in fflower or Meal upon or at the Water Corn Mill of the said James ffarrer in Sadleworth aforesaid called the Upper Mill and not elsewhere and pay the accustomed Toll or Multure for the grinding thereof And that the said John Winterbottom his Executors Administrators and Assigns shall and will from Time to Time and at all Times during the said Term of One Hundred and ffifty Years hereby granted well and sufficiently repair uphold maintain and keep all the Buildings on the said demised Premises and all the Hedges Ditches Waterbanks Gutters ffences Gates and Stiles of or to the said demised Premises belonging and all the hereby demised Premises in good sufficient and tenantable repair and the Ditches and Watercourses in the said Premises shall Cleanse and Scower and at the End or other sooner Determination of the said Term shall and will peaceably and quietly yield and deliver up all and every the same hereby demised Premises unto the said James ffarrer his Heirs and Assigns in such good and sufficient tenantable Repair and with the Watercourses and Ditches thereof well cleansed and scowered And that the said John Winterbottom his Executors Administrators and Assigns or any of them shall not cut fell lop or head any of the Trees of Oak Ash Elm or Poplar or any other Tree or Trees that now are or at any Time hereafter during the said Term of One Hundred and ffifty Years shall be set or growing in or upon the said Premises or any Part thereof nor shall cut any of the Underwood or Hedges thereof other than for servicing making or repairing the ffences belonging to the said demised Premises or other than Bryars Brambles and Gorse which it shall and may be lawful for him and them to cut dig and root up And that the said John Winterbottom his Executors Administrators and Assigns shall and will yearly and every Year during the said Term plant and set two young growing ffirs upon some most convenient Part or Parts of the Premises hereby demised and preserve the same from Hurt or Spoil And that the said John Winterbottom his Executors Administrators or Assigns shall not nor will at any Time during the said Term dig break up plow or convert into Tillage or arable Land or cause or promise to be so done any of the Meadow Ground or Land commonly used for meadowing hereby demised without the License and Consent of the said James ffarrer his Heirs or Assigns first had and obtained in Writing under his or their Hand nor shall in any one Year of the four last Years of the said Term plow grave or rive out more than one third Part of the Ley Pasture or arable Ground of the said demised Premises without such License as aforesaid on Pain in either of the Cases aforesaid to fforfeit and pay to the said James ffarrer his Heirs and Assigns a Sum of Money after the Rate of ffive Pounds an Acre for every quantity or parcel of Meadow Ley Pasture or arable Ground of the said demised Premises that shall be digged broken up or plowed contrary to this Present Covenant And also that all the Hay Straw Manure Dung and Ashes which during the said Term shall grow arise be gotten or made of in or upon the said demised Premises or any Part thereof shall be spent or left upon the same Premises And that the said John Winterbottom his Executors Administrators and Assigns shall during the last four Years of the said Term set and spread on the said demised Meadow Ground and not also where all the Manure Dung and Ashes that shall arise from or be gotten or made on the said demised Premises during the said four Years last mentioned or at any Time before and which at the Commencement of the said four Years shall remain unspread on the said Premises or the same not being so spread shall leave on the said demised Premises for the use of the said James ffarrer his Heirs and Assigns And that as often as the Court Baron of the Lordships of Manors of Sadleworth and Quick shall be held and the said John Winterbottom his Executors Administrators or Assigns shall have Notice thereof he and they shall appear and pay and perform Suit and Service at the said Court And that the said John Winterbottom his Executors Administrators or Assigns shall not at any Time or Times during the said Term of One Hundred and ffifty Years permit or suffer any new or unusual Ways or Paths in upon or over the said demised Premises or any Part thereof to be made or used by any person or persons whatsoever And also that he the said John Winterbottom his Executors Administrators and Assigns shall not at any Time during the said Term of One Hundred and ffifty Years kill or destroy or knowingly or willingly permit or suffer to be killed or destroyed any Game within the said Manors of Sadleworth and Quick or either of them Provided always that if the said John Winterbottom his Executors Administrators or Assigns shall at any Time or Times during the said Term of One Hundred and ffifty Years make cause or suffer to be made any wilful or voluntary Wast of in or upon the said hereby demised Premises or any Part thereof Or demise grant assign set over or exchange the said hereby demised Premises or any Part or Parts thereof to or with or suffer the same Premises or any Part thereof to be held or occupied by any Person or Persons whatsoever other than by to or the Use and Benefit of the Wife Child or Children of the said John Winterbottom, without the License and Consent of the said James ffarrer his Heirs or Assigns first had and obtained in Writing under his or their hand Or in Case the said John Winterbottom his Executors Administrators or Assigns shall neglect refuse or fail to pay do or perform any of the Boons fforfeitures Covenants or Agreements herein before contained on the part of the said John Winterbottom his Executors Administrators or Assigns to be paid done and performed That then and so often and in any of the Cases aforesaid it shall and may be lawful to and for the said James ffarrer his Heirs and Assigns to reenter on the said hereby demised Premises and enjoy the same as in his or their former Estate any thing herein before mentioned to the contrary thereof in any wise notwithstanding Provided also and it is hereby declared and agreed between the Parties to these Presents that it shall be lawful for the said James ffarrer his Heirs or Assigns at any Time or Times hereafter during the Term of One Hundred and ffifty Years to inclose all and every or any the Wasts and Commons of or belonging to the said Manors of Sadleworth and Quick or other of them and all and every or any the Wasts and Commons herein before demised or in which any Common of Pasture or Common of Turbary is hereby demised at the Will and Pleasure of the said James ffarrer his Heirs or Assigns and the same Wasts and Commons after the same shall be so included thenceforth to hold and enjoy to his and their Proper Also without the Interruption or Disturbance of or by the said John Winterbottom his Executors Administrators or Assigns And for the true performance of all and every the Covenants and Agreements herein before mentioned to be done and performed on the part of the said John Winterbottom his Executors Administrators or Assigns He the John Winterbottom doth hereby bind and oblige himself his Heirs Executors and Administrators unto the said James ffarrer his Heirs and Assigns in the Penal Sum of Eighteen Pounds and eighteen Shillings of lawful Money of Great Britain And the said James ffarrer for himself his Heirs and Assigns doth covenant and agree to and with the said John Winterbottom his Executors Administrators and Assigns by these Presents that he the said John Winterbottom his Executors Administrators and Assigns shall have Liberty of Haying or Outlet for his Cattle from the ffeast of the Purification of the blessed Virgin on which the said Term of One Hundred and ffifty Years shall expire or determine until the first Day of May then next following in the said hereby demised Close of Ground called the Great ffield And that it shall and may be lawful to and for the said John Winterbottom his Executors Administrators and Assigns paying the said yearly Rent herein before reserved and keeping and Performing the Covenants and Agreements herein before contained on his and their Parts to be kept and performed peaceably and quietly to have hold and enjoy all and every the said hereby demised Premises for and during the said Term of One Hundred and ffifty Years hereby granted without any Lett Suit Trouble Eviction or Interruption of or by the said James ffarrer his Heirs or Assigns or any of them or of any other Person or Persons whatsoever lawfully claiming or to claim by from or under him them or any of them In Witness whereof the Parties above named to these Presents have interchangeably set their hands and Seals the Day and Year first above written.
