Appendix 9 – 1770 John Winterbottom will and 1779 Probate

In the name of God Amen I John Winterbottom of Strines within Saddleworth in the County of York Clothier being in health and of sound mind and memory Do make this my last Will and Testament in maner following And first give and devise to my oldest Son Robert Winterbottom his Executors Administrators and Assignes all my leasehold messuages lands and premeses situate at Strines aforesaid which I hold by lease under James ffarrer Esquire for and during all my Estate farm and Interest therein subject to the Rents and Services comprised in such Lease Saving and except a Dwelling house in my said Son’s possession which I give to Ann my wife during her life so long as she keeps herself unmarried after my death Also I give to her for use and enjoyment of so many and such parts of my household ffurniture as she shall choose not exceeding the value of ten pounds and to be enjoyed by her during her life and so long as she continues my widow and unmarried and at her death or marriage again which shall first happen the said dwelling house so given shall belong to my said Son Robert and the Goods she makes choice of shall be deemed as part of the remainder of my personal Estate Also I give to my Grandson James the Son of John my Son the Sume of ten pounds when he attains the Age of twenty one Years Also I give out of my personal Estate unto my Executors hereafter named the sume of one hundred pounds In Trust that they & the Survivors or Survivor of them do place out the Same at Interest on good real or personal Security and yearly pay and apply such Interest unto the said Ann my wife for her further Support and Maintenance during her life and continuing my widow and unmarried and after her death or second marriage such Interest shall cease and I give both principle and Interest and all the residue and remainder of my personal Estate and Effects whatsoever (after payment of my just debts funeral and other Expenses attending the Execution of this my will) I give equally amongst all my Sons and Daughters that shall be living at my Death and if any of them dye in their minority and without issue I will that the part and share of him her or them so dying without issue shall go equally amongst my surviving Children Also I have already given my said Son John the Sume of twenty pounds in part of his portion and I will that the same Sume be deducted out of his share accrewing to him from the residue of my personal Estate hereby given amongst my Children It being my Intention that what I have already given or shall hereafter in my life time give or bestow in money or Effects to any of my Sons and Daughters the same shall be considered as paid out and as part of their several shares arising from this my last will and Testament except the said Leasehold premeses hereby given to my said Son Robert Also I nominate and appoint Robert Winterbottom and John Winterbottom my Sons my Brother James Winterbottom and my Kinsman John Lees of Oldham Innholder joynt Executors of this my last will and Testament In Testimony hereof I have hereunto set my hand and Seal this Eleventh day of January in the year of our Lord Seventeen hundred and Seventy

Renunciation of Executorship – January the 5th 1779 This is to Certify to all whom it may concern, that we whose names are hereunto Subscribed were jointly Nominated with Robert Winterbottom Executors of the Last Will & Testament of the Late Deceased John Winterbottom of Strines within Saddleworth Yorkshire But Revoke the same & give up all those concerns To the said Robert Winterbottom, As Witness our hands
